Terms of Service
Last Updated: October 26, 2023
Please read these Terms of Service carefully before using the services of BJGA Ventrice Auto Transportation LLC. Understanding the legal framework of our partnership is key to a successful relationship. By engaging our services, you acknowledge and agree to the following freight agreement and transportation policy.
1. Definitions
Broker: BJGA Ventrice Auto Transportation LLC, acting as a licensed freight broker arranging for the transportation of property by authorized motor carriers.
Shipper: The entity, customer, or person requesting the transportation services and responsible for the payment of freight charges.
Carrier: The underlying motor carrier selected to perform the physical transportation of the shipment.
Shipment: The goods, cargo, or property tendered by the Shipper for transport under this agreement.
2. Broker's Obligations
BJGA Ventrice Auto Transportation LLC agrees to arrange for the transportation of Shipper’s freight by motor carriers that are duly authorized to operate by the Dept. of Transportation (DOT) and the Federal Motor Carrier Safety Administration (FMCSA). Our role is strictly that of a broker; we do not personally transport the freight using our own equipment.
3. Shipper's Obligations
The Shipper must provide accurate and complete descriptions of the shipment, including weight, dimensions, and nature of the cargo. The Shipper is responsible for ensuring cargo is properly packaged, labeled, and prepared to withstand the rigors of transportation. Failure to disclose hazardous materials or specialized requirements may result in service cancellation or additional surcharges.
4. Rates and Payment
Payment for all services is due within 15 days of the invoice date unless otherwise specified in a signed service agreement. BJGA Ventrice reserves the right to adjust final pricing based on fluctuations in weight, dimensional changes, or fuel surcharges at the time of transit. Late payments are subject to a 1.5% monthly finance charge.
5. Liability and Claims
Broker assumes no liability for cargo loss, damage, or delay. The Carrier performing the service is solely liable for cargo claims under the Carmack Amendment (49 U.S.C. § 14706). All claims for loss or damage must be filed in writing with the Carrier within nine months of delivery, or in the case of non-delivery, within nine months of the scheduled delivery date. BJGA Ventrice will assist the Shipper in the processing of claims with the Carrier, but such assistance does not imply liability on the part of the Broker.
6. Insurance
BJGA Ventrice maintains a surety bond as required by law. We require all contracted Carriers to maintain a minimum of $1,000,000 in Public Liability insurance and $100,000 in Cargo Liability insurance. Shippers are encouraged to purchase their own contingent cargo insurance to cover high-value shipments beyond the Carrier's standard limits.
7. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of New York and applicable federal laws. Any legal proceedings arising from this freight agreement shall be filed in Westchester County, New York.
